General information on data processing

a) Scope of the processing of personal data

We only process our users' personal data to the extent necessary to provide a functional website and our content and services. The processing of our users' personal data only takes place regularly with the user's consent. An exception applies in cases where prior consent cannot be obtained for factual reasons and the processing of the data is permitted by law.

b) Legal basis for the processing of personal data

Insofar as we obtain the consent of the data subject for the processing of personal data, Art. 6 para. 1 lit. a EU General Data Protection Regulation (GDPR) serves as the legal basis.

When processing personal data that is necessary for the fulfilment of a contract to which the data subject is a party, Art. 6 para. 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures.

Insofar as the processing of personal data is necessary to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis.

In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis.

If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis for the processing.

c) Data erasure and storage duration

We adhere to the principles of data avoidance and data minimisation. The personal data of the data subject will be erased or blocked as soon as the purpose of storage no longer applies. Data may also be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.

The legal basis for the temporary storage of data and log files is Art. 6 para. 1 lit. f GDPR.

c) Purpose of the data processing

The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session.

Recipients of data and transfer of data to third countries

Recipients of data are employees within our company who need it to process the purposes listed below.

We may transfer your personal data to our affiliated company brandcom Köln GmbH (see legal notice) insofar as this is permitted within the scope of the purposes and legal bases set out below.

The data collected by us will not be passed on to third parties. Furthermore, we will not create any links to personal data without your consent.

The data will not be transferred to a third country.

E-mail contact, contact application form; purposes for which we process personal data; legal basis and categories of processing

If you contact us by email or via the contact form, the information you provide will be processed exclusively for the purpose of processing your contact enquiry and for possible follow-up questions.

As part of a balancing of interests to protect the legitimate interests of the controller or a third party in accordance with Art. 6 (1) f) GDPR, we process your data for the purpose of processing your enquiry.

On the basis of your consent in accordance with Art. 6 para. 1 a) GDPR, the lawfulness is given on the basis of the consent given to us in each case for the purposes stated in the consent. Consent given to us can be revoked at any time with effect for the future.

The data will be deleted as soon as it is no longer required to fulfil the purpose for which it was collected. For the personal data from the input screen of the contact form and those sent by email, this is the case when the respective conversation with the user has ended. The conversation is ended when it can be inferred from the circumstances that the matter in question has been conclusively clarified.

The user has the option to withdraw their consent to the processing of personal data at any time. If the user contacts us by e-mail, they can object to the storage of their personal data at any time. In such a case, the conversation cannot be continued. All personal data stored in the course of contacting us will be deleted in this case.

If we process personal data about you for the purpose of your application for an employment relationship, this will only be done to the extent necessary for the decision on the establishment of an employment relationship. The legal basis for this is § 26 para. 1 in conjunction with. para. 8 sentence 2 BDSG.

Furthermore, we may process personal data about you insofar as this is necessary for the defence of legal claims asserted against us in the application process. The legal basis for this is Article 6(1)(f) GDPR; the legitimate interest is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).

If an employment relationship is established between you and us, we may process the personal data already received from you for the purposes of the employment relationship in accordance with Section 26 (1) BDSG if this is necessary for the performance or termination of the employment relationship or for the exercise or fulfilment of the rights and obligations of employee representation arising from a law or a collective agreement, a works or service agreement (collective agreement).

We process data in connection with your application. This may be general personal data (such as name, address and contact details), information about your professional qualifications and schooling or information about further professional training or other information that you provide to us in connection with your application. We may also process job-related information that you have made publicly available, such as a profile on professional social media networks.

We store the personal data you provide for the purpose of your application for as long as is necessary to make a decision about your application. If an employment relationship is not established between you and us, we may also continue to store data if this is necessary for the defence against possible legal claims. In this case, the application documents will be deleted four months after notification of the rejection decision, unless longer storage is required due to legal disputes.

Newsletter

You can subscribe to a free newsletter on our website. When you register for the newsletter, the data from the input screen is transmitted to us.

The following data is collected by us: E-mail address (mandatory field), surname, first name and company name

The following data is also collected during registration

  • IP address of the accessing computer
  • Date and time of registration
  • Your consent is obtained for the processing of the data as part of the registration process and reference is made to this privacy policy.

No data will be passed on to third parties in connection with the data processing for sending newsletters. The data is used exclusively for sending the newsletter.

The legal basis for the processing of data after registration for the newsletter by the user is Art. 6 para. 1 lit. a GDPR if the user has given consent.

The purpose of collecting the user's email address is to deliver the newsletter.

The collection of other personal data as part of the registration process serves to prevent misuse of the services or the email address used.

The data is deleted as soon as it is no longer required to fulfil the purpose for which it was collected. The user's e-mail address is therefore stored for as long as the subscription to the newsletter is active.

The other personal data collected during the registration process is generally deleted after a period of seven days.

Right of objection and cancellation

The subscription to the newsletter can be cancelled by the user concerned at any time. For this purpose, there is a corresponding link in every newsletter.

This also makes it possible to revoke consent to the storage of personal data collected during the registration process.

This website uses Google AdWords. AdWords is an online advertising programme of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google").

As part of Google AdWords, we use what is known as conversion tracking. When you click on an advert placed by Google, a cookie is set for conversion tracking. Google stores your data (even for users who are not logged in) as usage profiles and analyses them. The collection, storage and evaluation are carried out in accordance with Art. 6 para. 1 lit.f GDPR on the basis of Google's legitimate interests in the display of personalised advertising, market research and/or the needs-based design of Google websites. You have the right to object to the creation of these user profiles, whereby you must contact Google to exercise this right.
